Ebay to Pay $3 Million in Connection with Harassment Campaign

E-commerce giant eBay has recently agreed to pay a hefty sum of $3 million in connection with a shocking harassment campaign that took place in 2019. The harassment was directed at a Massachusetts couple, Ina and David Steiner, who were known for their critical coverage of the e-commerce site. The US Department of Justice (DOJ) announced the maximum criminal penalty on Thursday, unveiling that eBay had committed six felony offenses.

The Heinous Harassment Campaign

In 2019, a group of seven eBay employees, including some executives, devised a plan to target the Steiners. The couple ran an e-commerce newsletter that provided critical analysis of eBay. To silence their reporting and protect the eBay brand, the employees resorted to outrageous measures. They not only sent online threats but also visited the couple’s home to conduct surveillance. In an even more disturbing fashion, the employees sent grotesque items to the Steiners, including a bloody pig mask, a funeral wreath, live insects, and a book about coping with the death of a spouse. This campaign of terror and intimidation showcases a total lack of ethics and regard for others.

The US Department of Justice has charged eBay with multiple offenses in connection with the harassment campaign. These charges include two counts of stalking through interstate travel, two counts of stalking through electronic communications services, one count of witness tampering, and one count of obstruction of justice. Such charges emphasize the gravity of the actions taken by eBay employees.

Former eBay security director James Baugh and the company’s former director of global resiliency have already been sentenced to prison in 2022 for their involvement in the campaign. Additionally, five other employees have also been charged. This highlights that the law does not tolerate such criminal conduct, regardless of a person’s position within a company.

As part of the deferred prosecution agreement, the US Department of Justice is imposing requirements on eBay to rectify the situation and prevent such incidents from happening in the future. One of the key requirements is that eBay must retain a corporate compliance monitor for three years. This monitor will ensure that eBay is in strict compliance with the law and ethical standards.

Furthermore, eBay is also expected to make extensive enhancements to its compliance program. These enhancements aim to create a culture of ethical behavior within the company and hold employees accountable for their actions. eBay’s Response and Accountability

In response to the agreement with the DOJ, eBay has officially taken responsibility for the misconduct of its former employees. The company acknowledged that its conduct in 2019 was both wrong and reprehensible. eBay CEO Jamie Iannone expressed remorse, stating that eBay has cooperated fully with law enforcement authorities since the moment they became aware of the events in 2019.

Legal Repercussions and Ongoing Lawsuit

In 2021, the Steiners sued eBay and former CEO Devin Wenig, asserting that the company engaged in a campaign to intimidate and silence them through threats, torture, and stalking. A judge ruled in December of that year that the couple’s case can proceed, indicating that eBay might have further battles to fight in the courtrooms.

The staggering $3 million penalty imposed on eBay serves as a reminder that no company is above the law.
